LOTMONKEY APPLICATION PRIVACY POLICY

This notice of privacy practices was updated on October 20, 2023.

What our Privacy Policy Covers

 

This Privacy Policy covers any personal information that LotMonkey, Inc (collectively referred to in this document as “we” or “us”) obtains from you when you use:

  • services, software, or other features of the LotMonkey Application (“our Application”), as well as services and features of third party websites when accessed through the LotMonkey Application, and

  • a device to scan a Quick Response or “QR” code or send a text message request.

Data obtained through the short code (SMS) program will not be shared with any third-parties for their marketing reasons/purposes.

As you can see, the Privacy Policy is split into two sections:

Visitors to and Account Holders of Our Application and Users of a Device to: Scan a QR Code Generated by LotMonkey services through the LotMonkey application and Send a Text Message Request.

Our Privacy Policy may change in the future. We invite you to check back periodically to see if we have made any changes. If we make any material changes, we will post a notice through the LotMonkey Application and will obtain your consent if the material changes affect the way we use the personally identifiable information we have already collected from you.

Your access of and use of our Application means you agree to the terms in this Privacy Policy and our Terms of Use. If you do not agree to the terms of our Privacy Policy, you should not use our Application. Information We Collect


As a user of our Application, we may ask you to share personal information with us. Whether you choose to give us information is completely up to you, but keep in mind that if you withhold information, you may be unable to use some of our services. We collect information from a variety of sources, including information provided by you, information we collect when you use our Application, and information we collect about you from third party sources.

 

The following are examples of the types of information we may collect when you use our Application:

  • Information you provide: name, address (billing and shipping), zip code, e-mail address, telephone number(s), mobile number(s), credit card number(s), birth date, and password, etc.;

  • Information associated with use of our Application: the information gathered from cookies, such as IP address, to enhance your experience on our Application;

  • Information associated with doing business with us: transaction information, including the items purchased, and the date and time of your transaction; and

  • Information from third party sources: we may receive your updated shipping information from a third party carrier.

 

How We Use Information


Personal information. We may use the information we collect to process a transaction, provide the products or services you request, to improve our Application, to enhance your experience while using our Application, to manage your account and provide you with customer support, to communicate with you by email, postal mail, telephone and/or mobile devices about products or services that may be of interest to you, for marketing and promotional purposes, to manage our business, to perform functions as otherwise described to you at the time of collection, and to enforce or exercise any rights in our Terms of Use. We may combine information about you that we collect on-line, via mobile applications, and from third party sources.

 

Financial information. We may use financial information or payment method to process payment for any purchases made on our Application, enroll you in the discount, rebate, and other programs in which you elect to participate, to protect against or identify possible fraudulent transactions, and otherwise as needed to manage our business.

 

How We Collect Information

Information collected automatically. We automatically collect information from your browser when you use the Application. This information includes your IP address, your browser type and language, access times, the content of any undeleted cookies that your browser previously accepted from us (see "Cookies" below), and the referring web site address.

 

Cookies. A cookie is a small piece of information sent by a web site that is stored on your hard disk by your computer’s browser. The Application uses two kinds of cookies: session cookies and persistent cookies. Session cookies exist only for as long as your browser remains open. We use session cookies, for example, to add items to your shopping cart. Persistent cookies last from visit to visit; they do not go away when you exit your browser. At lotmonkey.com, we may use persistent cookies to give you a more personalized user experience and to help you navigate our Application more efficiently. For example, we may use persistent cookies to show you items you have previously browsed. Managing cookies preferences differs from browser to browser so please refer to your browser for further information. If you would like to disable cookies from our Application, please use the help function in your web browser to restrict cookies from our Application.

 

Information Sharing

 

Personal Information: We may share your information within LotMonkey authorized print partners, and LotMonkey affiliates and subsidiaries. Otherwise, we do not share your personal information with others except as indicated below or when we inform you and give you an opportunity to opt out of having your personal information shared. We may share personal information with:

  • Service Providers. We may share your information with third party service providers with whom we have relationship solely for the purpose of delivering the purchased service or product requested. For example, we may share your personal information with companies that perform services for us, such as fulfilling orders, delivering packages, sending postal mail and e-mails, analyzing customer data, providing marketing and promotional assistance, processing credit card payments, investigating fraudulent activity, conducting customer surveys, and providing customer service. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

  • Other Situations. We also may disclose your information, including personal information:

    • In response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

    • When we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our Application’s Terms of Use or other agreements or policies.

    • In connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

 

Users of Associated Accounts. If you are the user of an associated account, then information, including your personal information that you provide to us is accessible to the holder of the service account.

 

Aggregated and non-personal information: We may share non-personal information we collect under any of the above circumstances. We may also share it with third parties to develop and deliver targeted advertising through our Application and on web sites of third parties, and to analyze and report on advertising you see. We may combine non-personal information we collect with additional non-personal information collected from other sources. We also may share aggregated, non-personal information with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis.

 

What Happens to my Personal Information if my Account is terminated?

 

When your LotMonkey account is terminated (either voluntarily or involuntarily), all of your personally identifiable information is placed in "deactivated" status on our relevant www.lotmonkey.com databases. However, deactivation of your account does not mean your personally identifiable information has been deleted from our database entirely. We will retain and use your personally identifiable information as necessary in order to comply with our legal obligations, resolve disputes, or enforce our agreements, as further detailed in our Terms of Use.

 

Third Party Web Sites

There are a number of places on our Application where you may click on a link to access third party web sites that do not operate under this Privacy Policy. For example, if you click on an advertisement on our website, you may be taken to a website that we do not control. This policy does not cover the privacy practices of Third Party Sites, or of companies that we do not own, operate or control, or the actions of people that we do not employ or manage. We encourage you to check the privacy policies of those third parties when providing personally identifiable information through Third Party Sites.

 

Additionally, we may choose to work with trusted third party social network web sites like Facebook, and with application developers who specialize in social commerce so we can connect to your social networks. Other social networks we may use include but are not limited to Twitter, Instagram, and Linked-In. All of these companies operate Third Party Sites. We provide access to our Application by third parties and business partners so we can generate interest in our products and services among members of your social networks and to allow you to share product interests with friends in your network.

 

The use of any features made available to you on our Application by a third party may result in information being collected or shared about you by us or by the third party. Information collected or shared through any such third party features is considered "public information" by us because the third party sites made it publicly available. If you do not want us to be able to access information about you from third party sites, you must instruct third party sites not to share the information. We cannot control how your data is collected, stored, used or shared by third party sites or to whom it is disclosed. Please be sure to review the privacy policies and privacy settings on your social networking sites to make sure you understand the information they are sharing. If you do not want a Third Party Site to share information about you, you must contact that site and determine whether it gives you the opportunity to opt out of sharing such information. We are not responsible for how these third parties may use information collected from or about you. However, we do identify any areas on our Sites where third parties share information about you.

E-mail: To opt-out of receiving promotional or marketing e-mails from lotmonkey.com, you may:

  • when you register for an account with lotmonkey.com, un-check the "contact me about upgrades, product news, and offers" as well as "subscribe to newsletter",

  • unsubscribe by signing into your account on lotmonkey.com, clicking on “subscriptions” and indicating your opt-out preference,

  • use the unsubscribe link at the bottom of any e-mail sent by lotmonkey.com,

    • "NO MAIL OFFERS" (if you don’t want to receive offers by mail)

    • "NO PHONE OFFERS" (if you don’t want to receive offers by phone); or

    • "NO PHONE OR MAIL OFFERS" (if you don’t want to receive either).

 

Note: Because listings often are prepared well in advance (12-16 weeks, in many cases) you may continue to receive some offers after you send us your request.

 

Security

Your security is a priority at lotmonkey.com. We take appropriate security measures (including physical, electronic and procedural measures) to help safeguard your personal information from unauthorized access and disclosure. Secure Socket Layering (SSL) technology is used to encrypt your personal and credit or debit card information, while it is transmitted over the Internet from your computer.  SSL is an industry standard technology for secure online transactions. To protect your information once we receive it, we place it on systems behind secure firewalls, which are communication-management computers designed to keep information safe and inaccessible to other Internet users. your browser doesn’t accept the SSL technology, transactions will not be permitted. To confirm that your connection is secure, look for the letters "https" (rather than "http") located in the URL address window at the top of your browser to indicate that you are using a secure browser.

 

We want you to feel confident using our Services to transact business. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, searches, or other communications will always remain secure. Users should also take care with how they handle and disclose their personal information and should avoid sending personal information through insecure email. Please refer to the Federal Trade Commission’s website at http://www.ftc.gov/bcp/menus/consumer/data.shtm for information about how to protect yourself against identity theft.

Access Your Information

If you have an online account with us, you have the ability to review and update your personal information online by logging into your account and clicking on your account settings. If you have questions about your products, you may check your order status online in My Products section of the LotMonkey Application. More information about how to contact us is provided below. If you have an online account with us, you also may close your account at any time by visiting the "Account Settings" page for your account. After you close your account, you and anyone who held an associated account attached to your account will not be able to sign in to our Application or access any of your or their personal information. However, you can open a new, separate account at any time or re-activate your previous account by following instructions we will give you at the time you close your account. If you close your account, as per our Terms of Use, we may still retain certain information associated with your account for analytical purposes and recordkeeping integrity, as well as to prevent fraud, collect any fees owed, enforce our Terms of Use, take actions we deem necessary to protect the integrity of our Application or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

Your California Privacy Rights

Under California law, a California resident with whom we has an established relationship has the right to request certain information with respect to the types of personal information we have shared with third parties for their direct marketing purposes, and the identities of those third parties, within the immediately preceding calendar year, subject to certain exceptions. Transfer of Data Abroad

If you are using our Application from a country other than the country in which our servers are located, your communications with us may result in the transfer of information across international boundaries.  By using our Application and communicating electronically with us, you consent to such transfers.

Users of a Device to: Scan a QR Code Generated by LotMonkey services accessed through the LotMonkey Application or Send a Text Message Request

 

Data obtained through the short code program will not be shared with any third-parties for their marketing reasons/purposes.

What we collect. When you or another person uses a device to scan a Quick Response Code (“QR” code) generated by LotMonkey services of lotmonkey.com, we automatically collect the following information:

  • A time stamp, i.e., the time at which your device scanned the specific QR code

  • Operating system of device (Android, iPhone, etc….),

  • Browser type (FireFox, Microsoft, etc….),

  • IP Address (Internet Exchange for Service Provider), and

  • If you have “geo-location” activated, i.e., “turned on”, your device’s geographic location in terms of Longitude and Latitude

 

When you or another person uses a device to send a request via a text message, we automatically collect the following information:

  • The device’s telephone number;

  • The device’s wireless carrier (Verizon, Sprint, T-Mobile, etc….)

  • The content of the message received by the system; and

  • Time stamp, i.e., the time at which your device sent the message.

 

How we use and share the collected information. The information collected through the above-identified methods is used to produce analytics reports for the account in the Mobile section of the account of the user in the lotmonkey.com system that generated the code. This information is not shared with any third-parties for their marketing reasons/purposes. This information is not used by LotMonkey for any marketing reasons/purposes.
